1. About these terms

These terms and conditions set out the basis on which Blastcraft Limited (“Blastcraft”, “we”, “us”) quotes for and carries out abrasive blasting, water blasting, spray painting and protective coating work. By accepting a quote or asking us to start work, you agree to these terms.

2. Quotes and pricing

• Quotes are provided in writing and are based on the condition of the item or structure as described or inspected at the time of quoting.
• Quotes remain valid for the period stated on the quote. Where no period is stated, a quote is valid for 30 days.
• If the condition of the work differs materially from what was quoted (for example, hidden corrosion, contamination or a previously applied coating that was not visible) we will contact you before proceeding with any additional work or cost.
• Prices are stated exclusive of GST unless the quote says otherwise.

3. Scope of work

The work we will carry out is the work described in the accepted quote. Anything not listed in the quote (including reassembly, transport, masking of adjacent surfaces, or making good pre-existing damage) is outside the scope unless it has been agreed in writing.

4. Customer responsibilities

• Items delivered to the workshop should be free of fluids, loose fittings and anything that could be damaged by blasting or coating. Please tell us about anything that must be protected.
• For on-site work, safe and reasonable access to the work area, along with any site inductions, permits or shutdown arrangements, is the customer’s responsibility unless otherwise agreed.
• You confirm that you own the items supplied or are authorised to have the work carried out on them.

5. Coatings and finish

Coating systems are selected and applied in line with the coating manufacturer’s published instructions and the intended service environment. Cure and service life depend on the substrate, exposure conditions, handling and ongoing maintenance, so no particular lifespan is guaranteed beyond what the coating manufacturer states.

6. Timing

Any timeframes given are estimates made in good faith. Blasting and coating work is affected by weather, temperature, humidity and workload, and we are not liable for loss arising from a delay outside our reasonable control.

7. Payment

• Unless credit terms have been agreed in writing, payment is due on completion of the work or on collection of the item.
• Where an account has been approved, payment is due by the 20th of the month following invoice.
• Goods remain our property until paid for in full, and we may retain items in our possession until the account is settled.

8. Storage of items

Items left with us for more than 30 days after completion may incur reasonable storage charges. We will contact you before applying any such charge.

9. Liability

To the extent permitted by law, our liability for any claim relating to the work is limited to re-performing the affected work or refunding the amount paid for it. We are not liable for indirect or consequential loss, including loss of profit or production downtime.

10. Consumer Guarantees Act

Where you acquire our services as a consumer, nothing in these terms limits your rights under the Consumer Guarantees Act 1993. Where the services are acquired for business purposes, the Consumer Guarantees Act does not apply.

11. Health and safety

Blasting and coating work involves abrasive media, high pressure equipment and coating products. Visitors to the workshop must follow all site instructions and stay clear of active work areas.

12. Governing law

These terms are governed by New Zealand law and the New Zealand courts have jurisdiction over any dispute arising from them.
